Utah’s succession to statehood was a stormy one that included five unsuccessful attempts.  In 1896, statehood was finally approved, and a trusts for Utah’s public schools and eleven other beneficiaries were established.


The Enabling Act of 1894 granted square mile sections 2, 16, 32, and 36 in each 36 square mile township to support the common schools. The Utah State Constitution not only protected these lands, but set up guidelines for their usage.


The total granted trust land acreage was 7.5 million acres.  The state, as trustee, still retains 44% of the original grant with ninety percent of the remaining acres belonging to the common school trust or trust for K-12 public schools.


The School and Institutional Trust Lands Administration (SITLA) manages the land in a diverse range of surface and mineral revenue generating activities. Oil and gas provide the largest contribution. All proceeds from school lands, minus management expenses, flow into the permanent State School Fund. The State Treasurer invests the permanent funds, retains the capital gains, and distributes the interest and dividends annually.


For schools, the revenue is received in every public school in the state through the School LAND Trust Program. School Community Councils, consisting of the principal, elected school employees and elected parents, prepare plans to address the academic needs of students with their school’s annual dividend. Local school boards approve the plans and hold each school accountable through annual reports of plan implementation.

The School Children’s Trust Section at the Office of the Utah State Board of Education represents, supports and advocates for the public school beneficiaries. The section administers the School LAND Trust program and oversees the School and Institutional Trust Land Administration (SITLA) and the School and Institutional Trust Fund Office (SITFO).
